I hereby express my interest in signing the Developer’s standard booking form (the “Booking Form”) in order to make an offer to purchase a property within the Development (the “Property”) from the Developer when individual properties within the Development become available for sale.

 1 I acknowledge that the Booking Form will not be a sale and purchase agreement and will, if returned by me to the Developer in accordance with its terms, only represent my offer to purchase the Property, and that any sale is conditional on the Developer accepting my offer.

2 I understand that I must sign the Booking Form and comply with the obligations therein immediately after the Booking Form is sent to me by the Developer, otherwise the Developer may proceed to offer and sell the Property to another potential purchaser.

3 In accordance with this EOI, I have submitted the deposit payment referred to at page 1 of this form. I acknowledge and agree that, if I sign the Booking Form, the Developer may apply the deposit payment towards amounts payable under the Booking Form. Any return, refund or release of the deposit payment shall be subject to the terms of this EOI and the Developer’s approval.  

4 This EOI does not constitute any contract, or establish any contractual relationship between myself and the Developer. I acknowledge that this EOI does not oblige me to purchase any property in the Development and the Developer has no obligation to sell to me any property in the Development.  

5 I acknowledge that the Developer shall be entitled to reject this EOI and return the deposit payment at any point and for any reason, without the need for any formal notice, legal proceedings, court order or any other documentation.  

6 This EOI does not relate to a particular property within the Development and is a general expression of interest relating to the Development and the property type referred to at page 1 of this form. Any property number, type and areas stated in this EOI are indicative only and the actual property number, type and areas will be subject to agreement with the Developer and shall be set out within the Booking Form.  

7 I acknowledge and accept that any prices or payment terms presented by or discussed with the Developer and/or set out in this EOI are subject to change and that the purchase price, deposit amounts and payment schedule referred to at page 1 of this form may not be final. The final purchase price and payment terms relating to my purchase of the Property (if any) will be set out within the Booking Form.  

8 I accept that this EOI is non-transferable and non-assignable by me and I agree to keep this EOI confidential and shall not disclose its contents to any third party, other than my legal or financial advisors, or as otherwise required by law.  

9 I acknowledge and accept that the Development is in the process of being registered with the relevant authorities in Dubai and the Developer makes no warranty or representation that such registration will be completed.  

10 This EOI may be signed and exchanged electronically, including through the use of digital or encrypted signatures, and such signatures shall be deemed valid, binding and effective for all legal purposes, and shall have the same legal force and effect as handwritten signatures.
